3240 - Disposal of School Property

  1. PURPOSE AND PHILOSOPHY
    The purpose of this policy is to ensure the lawful, transparent, and fiscally responsible disposal of school district property that is no longer required to meet the educational needs or operational interests of the Weber School District. The District is committed to managing public assets in a manner that complies with Utah law and protects the public trust. The Board of Education recognizes that all district property is held in trust for the benefit of students and the community. When property becomes surplus, the Board believes it should be disposed of in a manner that complies with applicable state statutes and regulations, promotes sound financial stewardship and accountability, maximizes public value and fairness, and maintains transparency and integrity in the disposition process.

  2. POLICY
    Whenever the Board of Education determines that any real property belonging to the Weber School District is no longer needed or necessary for the best interests of the District, such property shall be sold in accordance with the statutes of the State of Utah. Sale of Non Personal Property Whenever the Board of Education determines that non personal property belonging to the Weber School District is no longer needed or necessary for school purposes, the property will be sold in accordance with the statutes of the State of Utah.

  3. DEFINITIONS
    1. Eligible entity means city or town with a population density of 3,000 or more people per square mile; or a county whose unincorporated area includes a qualifying planning advisory.
    2. Real Property means land and permanent improvements affixed to land, including buildings.
    3. Personal Property (Non-Real Property) means all District-owned property that is not real property, including but not limited to equipment, furniture, vehicles, instructional materials, and supplies.
    4. Surplus Property means land owned by a school district that was purchased with taxpayer money,  is located within a city or town that is an eligible entity or within a qualifying planning advisory area, consists of one contiguous tract at least three acres in size, and has been declared by the school district to be surplus.

  4. PROCEDURES
    1. Sale of  Real Property
      1. Whenever the Board of Education determines that any real property belonging to the Weber School District is no longer needed or necessary for the best interests of the District, the property may be declared surplus.
      2. Surplus real property shall be sold or otherwise disposed of in accordance with Utah Code Title § 53G-4-902. Notice to eligible governmental entities as required by statute;
        1. Compliance with statutory timelines and priority rights;
        2. Use of proceeds in accordance with state law.
      3. Real property shall be sold only upon the affirmative vote of at least two-thirds of all members of the Board of Education.
      4. The Board may authorize the Superintendent or designee to carry out the statutory requirements and complete the transaction consistent with Board action.
    2. Sale or Disposal of Non Personal Property
      1. Whenever the Board of Education determines that non personal property belonging to the Weber School District is no longer needed or necessary for school purposes, the property may be declared surplus.
      2. Surplus personal property shall be disposed of in accordance with applicable Utah law and District administrative procedures, which may include:
        1. Reassignment within the District;
        2. Transfer to another governmental entity;
        3. Sale through competitive bidding, auction, or other lawful means;
        4. Recycling, donation, or disposal when the property has no remaining value.
      3. Disposal methods shall be designed to promote fiscal responsibility, transparency, and appropriate recordkeeping.
